Legally secure implementation of the judgments on Corona emergency aid (amendment request by the GREENS and CDU)
Two amendments were submitted to the state parliament for a roll-call vote on the SPD parliamentary group's motion entitled "Repayments of Corona emergency aid illegally demanded by Minister Dr. Hoffmeister-Kraut (CDU) according to the Administrative Court: Extent of the damage to companies and the self-employed in Baden-Württemberg." The SPD parliamentary group's first amendment is intended to supplement the original proposal with clear consequences from the rulings of the Mannheim Administrative Court. The court decided that claims for the reimbursement of Corona emergency aid from companies and self-employed people who submitted their applications up to and including April 7, 2020 were unlawful. The SPD therefore demands that the state government correct this misconduct and not place any further burden on those affected. Specifically, the SPD demands that all illegal demands for repayment be waived, regardless of whether those affected have sued or not. This should also expressly include those cases in which companies or self-employed people have already repaid or are still being asked to repay, relying on lawful government action, even though this would not have been permissible according to the case law of the Administrative Court. In addition, the group demands that no more interest be collected or enforced in these cases until a final settlement has been reached. The amendment was rejected with 108 votes against. 34 MPs voted in favor, there were no abstentions.
