Law on the adoption of a supplement to the state budget for the financial years 2025/2026 (motion for a resolution)

The SPD parliamentary group has submitted an application for the law on the establishment of an addendum to the state budget of Baden-Württemberg for the financial years 2025/2026, which deals with the Corona emergency aid from spring 2020. Against the background of the jurisprudence of the Administrative Court, the SPD is calling on the state government to waive all illegal demands for repayment, regardless of whether those affected have sued or not. This should also explicitly include final cases in which companies have already repaid or have been asked to repay, relying on the legality of the government's decisions, even though this should not have been done according to current case law. In addition, any repayments already made, including any interest, should be immediately refunded to those affected. The SPD parliamentary group's motion for a resolution was rejected with 97 votes against, 47 votes in favor and no abstentions.
